Terms and Conditions

The terms on which we sell to you through this website.

These terms govern your use of this website and any purchase you make through it. By browsing or ordering, you accept them. Please read them alongside our Privacy Policy, Shipping and Delivery policy and Returns and Refunds policy, which form part of these terms.

Who may order

You must be at least 18 years old, or shopping under the supervision of a parent or guardian, and able to enter a binding contract. You agree that the information you give us — name, delivery address, phone number, email — is accurate and current.

Products, colour and handwork

We photograph every piece as faithfully as we can, but screens render colour differently and fabric behaves differently in daylight. Minor variation between the image and the piece you receive is normal.

Because our embroidery is done by hand, small differences in placement, density and finish occur between pieces of the same design. This is inherent to handmade clothing and is not treated as a defect.

Pricing and taxes

Prices are shown in Indian Rupees and include applicable taxes unless stated otherwise at checkout. Shipping is calculated and shown before you pay. We may change prices at any time, but a change never affects an order we have already confirmed.

If a price or product description is listed in error, we reserve the right to cancel the affected order and refund you in full, even after the order is confirmed.

Orders and acceptance

Your order is an offer to buy. Our confirmation email acknowledges receipt; the contract forms when we dispatch the piece. We may decline or cancel an order — for example where stock is unavailable, a payment fails verification, delivery is not serviceable, or we suspect fraud or resale — and will refund any amount taken.

Payment

Payments are processed by Shopify's PCI-DSS compliant checkout and the payment providers it supports. We do not receive or store your full card details. You confirm that the payment method you use is yours or that you are authorised to use it.

Shipping, returns and refunds

Delivery timelines, shipping charges, customs liability, the return window, exclusions and refund timelines are set out in our Shipping and Delivery and Returns and Refunds policies. Those documents apply in full to every order.

Intellectual property

All content on this website — designs, photography, illustration, text, the Khatuba name and logo, and the arrangement of the site itself — belongs to Khatuba or its licensors. You may not copy, reproduce, republish or use it commercially without our written permission. Reproducing our designs for manufacture or resale is expressly prohibited.

Acceptable use

You agree not to use this site unlawfully, to attempt to gain unauthorised access to it, to introduce malicious code, to scrape it systematically, or to place orders fraudulently or for resale without our consent. We may suspend or refuse service where we reasonably believe any of these are happening.

Reviews and submissions

If you send us a review, photograph or comment, you confirm it is your own, does not infringe anyone's rights, and grant us a non-exclusive licence to display it in connection with the product. We may decline or remove submissions that are unlawful, abusive or misleading.

Third-party links and services

The site may link to or embed third-party services — couriers, payment providers, analytics and social platforms. We do not control them and are not responsible for their content or practices. Their own terms and privacy policies apply.

Limitation of liability

To the fullest extent permitted by law, Khatuba is not liable for indirect, incidental or consequential loss arising from your use of this site or from any product bought through it. Where liability cannot lawfully be excluded, it is limited to the amount you paid for the order in question. Nothing in these terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

Force majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including natural events, strikes, courier failure, civil disruption, government restriction or interruption of power or telecommunications.

Governing law

These terms are governed by the laws of India, and the courts having jurisdiction over the place where Khatuba is registered shall have exclusive jurisdiction over any dispute.

Changes to these terms

We may update these terms as our business or the law changes. The version published here is the one that applies, and the date below tells you when it last changed. Orders are governed by the terms in force when they were placed.
